Disclaimer

These Terms and Conditions (the “Terms”) are made effective as of the date reflected on the applicable estimate and or invoice by and between ProClean Softwash Company, LLC (the “Contractor”) a Texas Limited Liability Company of 14450 FM2100 Suite A-302 Crosby, Texas 77532, and any authorized party (the "Client") authorizing, approving, or paying for services to be performed at the as listed address on the estimate and or invoice, (collectively, the “Parties”).

These Terms will not take effect, and Contractor will have no obligation to provide Services, until Client returns an approved copy of the applicable estimate, and the subsequent conditions as outlined in this document where applicable.

Legally Binding Agreement

By authorizing the Contractor to perform services on your behalf, you enter into a legally binding agreement, thereby affirming your acceptance of the terms and conditions set forth herein. This contract encompasses the completion of work at a mutually agreed-upon price, reflecting the commitment and understanding between the Parties. In the event that you fail to uphold your obligations under these Terms, you acknowledge that all deposits made to the Contractor shall be forfeited as liquidated damages, where applicable. This provision serves to protect the Contractor's interests and ensure fair compensation for the resources allocated to your project.

Product Warranties

All warranties related to the services provided are strictly limited to those offered by the manufacturers of the cleaning products utilized in the course of our work. The Contractor expressly disclaims any additional warranties, whether implied or expressed, beyond those provided by said manufacturers. Should you have any concerns or issues regarding the services rendered, we encourage you to notify the Contractor immediately. Prompt communication allows us the opportunity to address your concerns swiftly and effectively, ensuring that your experience meets your expectations.

Water Use

By authorizing the Contractor to perform services on your behalf, you grant the Contractor the right to utilize an on-site water supply as necessary to complete the specified project, without any expectation of compensation for its use. Should the project require an exterior water supply, please be advised that this will incur an additional charge. To ensure a seamless and efficient service experience, it is the customer’s responsibility to verify that the water supply is operational and readily available prior to our arrival. In the event that the water supply is unavailable or malfunctioning, additional charges may apply to cover the inconvenience and any necessary adjustments to our service plan.

Electricity Use

By authorizing the Contractor to perform services on your behalf, you consent to grant the Contractor the right to access and utilize an on-site source of electricity as needed to successfully complete the specified project, without any expectation of compensation for its use. Should the nature of the project necessitate an external electricity source, please be aware that this may incur an additional charge. We appreciate your understanding in facilitating a smooth and efficient service experience, as access to reliable power is essential for the timely and effective execution of our work.

Colors & Tones

The inherent properties and species of wood, as well as their aging and weathering processes, can significantly influence the resulting color and tone of the stain applied. It is important to understand that variances may arise not only among individual boards but also across the entire project, as factors such as wood density, grain patterns, and other unique characteristics can differ widely throughout the material.

The Contractor and its associates make every effort to accurately represent the anticipated final finish, providing you with a visual guide to the overall color and tone you can expect. However, due to the natural variability of wood, it is essential to anticipate some degree of variation in the final finish. This variability is part of the unique charm and character of natural wood, and we are committed to delivering a beautiful result that enhances the beauty of your space while embracing its individuality.

Client Safety

While the Contractor is present on your property and actively performing work, it is essential for your safety and the well-being of all involved that you take responsibility for ensuring that all children, pets, and other individuals remain a safe distance away from the designated work area. This precaution is crucial in preventing accidents and ensuring a smooth workflow.

Additionally, when chemicals are utilized during the project, it is imperative that children and pets are kept off the work surface for a minimum of 8 hours following the completion of our work. This guideline is in place to safeguard against any potential exposure to chemicals, as well as to prevent any contamination or staining of clothing and personal items.

Please be aware that any staining or discoloration of personal property resulting from a failure to adhere to these guidelines will be deemed the responsibility of the Client. Your cooperation is greatly appreciated, as it helps us maintain a safe and efficient working environment while delivering the highest quality of service

Payment

Payments to the Contractor are due in accordance with the specified contract schedule and should be made by either check or cash, or any other payment method as mutually agreed. It is important to note that all remaining balances are always due upon the completion of the job. This policy ensures a smooth and efficient transaction process, allowing us to focus on delivering the highest quality of service.

Any deviations from this payment policy must be explicitly agreed upon in writing and included in our contract to ensure clarity and mutual understanding. In the event that payments are not made in accordance with the terms outlined in the contract, late charges will be promptly assessed on all outstanding balances.

Furthermore, the customer agrees to bear any collection costs incurred by the Contractor in relation to the collection of overdue balances. This includes, but is not limited to, legal fees and other related expenses. We appreciate your understanding and cooperation in adhering to these payment terms, which help us maintain a professional and productive working relationship.

Scheduling

Scheduling in a business where productivity is heavily dependent on weather conditions can present unique challenges. Inclement weather such as rain, high winds, or extreme temperatures, may necessitate adjustments to our planned schedule. While we strive to minimize any scheduling conflicts and ensure timely project execution, it is important to recognize that certain circumstances may arise that are beyond our control and could impact your project’s start and completion dates.

Appointment Cancellation

If you need to cancel a scheduled appointment, please do so at least 24 hours in advance. Cancellations made within 24 hours of the scheduled appointment will incur a non-refundable cancellation fee of $150. Additionally, any costs incurred to prepare for the project (i.e., purchased materials or supplied specifically for the project) will be reimbursed at cost plus a 20% surcharge.

Client Property

The removal and replacement of grills, deck furniture, planters, and any other personal items located in the work area are the sole responsibility of the homeowner. To ensure the safety and integrity of your belongings, we kindly ask that you remove any items that may obstruct our work prior to our arrival.

In the event that we need to temporarily move items from the deck or surrounding area to facilitate our services, please be aware that the Contractor will not be held liable for any damage, breakage, or issues related to storage that may occur during this process. This includes potential harm to furniture, decorative planters, or other personal property that may be inadvertently affected. If the removal and storage of these items require extra time or resources, additional charges may be applied to cover these services.

Damages

The Contractor shall not be held responsible for any damages that arise from pre-existing conditions, including but not limited to improperly installed siding, loose shingles or siding, broken or open windows, inadequately sealed windows and doors, wood rot, defective construction, improperly secured wires, loose or improperly installed gutters and leaders, as well as ineffective caulking. It is important to understand that these issues can compromise the integrity of your property and may be exacerbated during our cleaning process.

In particular, with aluminum siding and in certain cases involving vinyl siding, exposure to sunlight and weather can lead to bleaching or fading of colors over time. Our power washing services, which focus on removing chalky, gritty, or deteriorating surface materials, may inadvertently highlight these faded areas, making them more noticeable. Please be aware that the Contractor will not be responsible for any aesthetic changes resulting from these natural weathering processes.

Additionally, the Contractor cannot be held liable for any loose mortar that may dislodge during the cleaning process. Given the nature of our work, it is crucial to recognize that existing conditions may affect the outcome of our services. We recommend that homeowners address any structural concerns prior to scheduling our services to ensure the best possible results.

Stains

It is important to understand that certain stains may not be removable through power washing alone. For instance, tree sap, artillery fungus, and splatters from various stains and paints are examples of materials that often resist conventional cleaning methods. Despite our best efforts and the effectiveness of our equipment, some stubborn substances can pose significant challenges.

When we provide a quote for your project, we make every attempt to identify and point out these areas of concern to you. Our goal is to ensure that you have a clear understanding of the limitations regarding stain removal. In some cases, certain stains may prove to be completely unremovable, regardless of the techniques employed.

Watertight

Contractor expects that your property will be well-maintained and weathertight prior to the commencement of our services. This expectation encompasses all aspects of the property, including but not limited to electrical systems such as receptacles and light fixtures, as well as doors and windows. It is essential that these elements are in good repair to ensure optimal results during our work.

Contractor will not be held liable for any damages resulting from water infiltration due to poor or improper installation, maintenance, or repair of electrical components, doors, or windows. Ensuring that these features are functioning correctly and securely is the homeowner’s responsibility.

Additionally, while we will make every effort to address issues such as artillery fungus on exterior surfaces, the Contractor cannot guarantee its complete removal. This particular type of fungus can be particularly persistent and may require specialized treatment beyond our standard cleaning services. We appreciate your understanding in these matters, as our goal is to deliver the highest quality of service while managing expectations regarding potential limitations.

Window Spotting

Windows may develop water spots as a result of our services due to the cleaning process and the natural reactions of water with various environmental elements. While we strive to provide the best possible results, window cleaning is not included in our standard service unless explicitly agreed upon in writing prior to the start date. If you would like to include window cleaning in your project, we encourage you to discuss this with us so we can accommodate your needs effectively.

Concrete

The appearance of concrete can be influenced by a variety of factors, many of which are related to the conditions present at the time the concrete was initially poured and cured. As we clean concrete surfaces affected by dirt, mold, mildew, algae, and other pollutants, these contaminants often mask imperfections that may have been present all along. Once these substances are removed, the concrete may reveal any and all flaws, such as discoloration, uneven textures, or surface cracks, that were previously hidden. It’s important for the customer to understand that due to the natural variations in materials and the curing process, not all concrete surfaces will exhibit a uniform appearance—even within the same driveway, patio, sidewalk, or concrete slab. Each section may reflect different characteristics, leading to noticeable differences in color and texture. We appreciate your understanding of these nuances, as they are part of the inherent beauty and uniqueness of concrete surfaces.

Client shall grant access to and for Contractor the right to film, photograph, or otherwise capture images and videos of the project or services provided. These materials may be used for promotional purposes, including but not limited to posting on social media, websites, and other marketing platforms. You acknowledge that no compensation will be provided to you for the use of these images or videos. Contractor will make every effort to remove any confidential or identifying data from the material. If you observe any media post of your property that needs to be edited, removed or changes, please contact us for immediate removal or revision.
